1. Definiciones
“Provider” or “Elyon”: Elyon S.A.S. de C.V.
“Client”: Any individual or legal entity contracting Elyon services.
“Services”: Including but not limited to game servers (mainly Minecraft), web hosting, VPS, storage, and related services.
2. Service Scope
Elyon provides computing and network resources to host game servers, web applications, and other agreed services. Technical specifications, resource levels (CPU, RAM, bandwidth), and applicable rates are described in the contracted Plan.
3. Client Obligations
Provide truthful and complete information during registration and contracting. Keep contact and billing data up to date. Follow Elyon’s instructions for proper configuration and use of the Services.
4. Prohibitions
Strictly prohibited: use, distribution, hosting, or installation of leaked plugins — any software or add‑on obtained illegally or without proper license.
The Client may not use the Services for: illegal, defamatory, or fraudulent activities; sending mass unsolicited emails (spam); hosting unregulated adult content or content that violates the law; denial‑of‑service (DDoS) attacks or actions harming Elyon’s or third‑party infrastructure.
Breach entitles Elyon to immediately suspend or terminate service. Elyon will attempt to contact the Client via registered means. If no response within 24 hours, Elyon reserves the right to proceed with suspension or definitive termination without further notice.
5. Rates and Payments
Rates are set in the selected Plan and are subject to VAT or other applicable taxes. Payment is always in advance (14 days before due date or before receiving a new service) and recurring (monthly, quarterly, or yearly) per the Plan. In case of delay, Elyon will suspend service after 3 days of non‑payment and may terminate after 7 days.
6. “No‑questions” Refund Policy
Elyon offers a “no‑questions” refund policy valid for the first 7 calendar days after initial service contracting. To request a refund, the Client must email hola@elyonhost.net within the period. 7. Availability and Maintenance
Elyon guarantees a minimum monthly availability of 99.5%. If unmet, the Client may request compensation equal to 25% of the monthly value in credits within Elyon’s billing panel. Maintenance windows will be scheduled with at least 24 hours’ notice, except emergencies.
8. Security and Privacy
Elyon implements reasonable measures to protect data integrity and confidentiality. The Client is responsible for keeping credentials and content secure. For more details, see our Privacy Policy.
9. Termination
Elyon may terminate service immediately for violation of these Terms.
10. Disclaimer
Elyon will not be liable for indirect damages, lost profits, or data loss. In any case, total liability is limited to the amount paid by the Client in the 3 months prior to the triggering event. Note: We strongly recommend regular external backups. Elyon does not guarantee recovery in case of accidental loss.
11. Changes to Terms
Elyon reserves the right to modify these Terms. Any change will be published and considered effective 3 calendar days after publication. Continued use constitutes acceptance of changes.
12. Governing Law and Jurisdiction
These Terms are governed by Mexican law. For any dispute, parties submit to the competent courts of Mexico City.
